General Terms and Conditions (GTC)
1. Area of applicability
These General Terms and Conditions (GTC) are applicable to all contracts by DISAGU Schutzfolien Vertriebs GmbH with consumers (§ 13 BGB) and customers in the sense of §14 BGB (entrepreneur) that are concluded via our online shop Disagu.co.uk. A consumer is every natural person that concludes legal business for a purpose that cannot be assigned to commercial nor independent professional occupation.
2. Contract partner, customer service
The purchase contract is concluded with DISAGU Schutzfolien Vertriebs GmbH. Further information about us is available in the imprint. You can reach our customer service for questions, reclamations and complaints Mon-Fri 8:00-16:00 at the phone number +49-3581-8767596.
3. Contract conclusion
The illustration of the products in the online shop is not a legally binding offer but an unbinding online catalogue. By clicking the order button, you place a binding order of the goods in the shopping cart. The confirmation of the receipt of the order takes place together with the acceptance of the order immediately after dispatch by an automated email. The purchase contract is concluded with this E-Mail-confirmation.
Unless you selected credit card payment. Then the contract is concluded in any case at the time of credit card debit (upon conclusion of the order).
Unless you selected the payment method PayPal. Then the contract is concluded in any case at the time of confirmation of the payment instructions to the payment service provider.
4. Shipping costs
Shipping costs are added to the stated product prices. More information about the shipping costs is available in the offers.
5. Payment
Payment is done via advance payment, credit card, PayPal.
- Advance payment
Upon selection of the payment method advance payment we state our bank data and deliver the goods as soon as the amount is credited to our account.
- Credit card
The credit card is debited upon acceptance of the order.
- Paypal
You pay the invoice amount via the online provider PayPal. You must be registered there resp. must register first. After legitimation with the access data you can confirm the payment order to us. Further information will be available during the order process.
6. Cash payment upon pickup
You generally have the option of pickup at DISAGU Schutzfolien Vertriebs GmbH, An der Weißen Mauer 15, 02826 Görlitz, Deutschland, to the below stated opening hours: Mon-Fri 8:00-16:00
7. Packing station
We do not deliver to packing stations.
8. Offsetting
You only have the right to offset if your counterclaims were determined in court legally binding or were acknowledged by us in writing.
9. Right of retention
You can only enforce a right of retention insofar the claims result from the same contract relationship.
10. Proprietary right
The goods remain our property until full payment has been made.
11. Transport damages
If goods are delivered with apparent transport damages, please claim such defects to the forwarding company as soon as possible and contact us promptly. The neglect of a reclamation or contact has no consequences for your legal rights and their enforcement, specifically your right to guarantee. You do help us to enforce our own claims toward the forwarding company resp. transport insurance.

Consumers have a right to cancel within 1 month.

Your contract agreement may be rescinded in writing (e.g. letter, fax, e-mail) within 1 month without explanation or, if the product was delivered prior to expiration of said term, by return of goods. This terms starts with the receipt of this written notice, but not prior to the goods being delivered to the customer (in the case of recurring deliveries of the same type, the first partial delivery) nor prior to fulfilment of our information obligations pursuant to Article 246 § 2 in conjunction with § 1 para. 1 and 2 Introductory Act to the German Civil Code and our obligations pursuant to § 312g para. 1 clause 1 German Civil Code in conjunction with Article 246 § 3 Introductory Act to the German Civil Code. Consequences of cancellation
In the event of effective cancellation both parties shall return the services received and surrender any benefits (e.g. interest). In the event you are unable to return or surrender the services received from us and the associated benefits (e.g. benefits of use) in whole or in part or only in a deteriorated condition, you will be liable for compensating us. With respect to deterioration of the product and the benefit of use you are only liable to compensate us if such benefits or deterioration of the goods can be ascribed to handling the goods beyond verifying the properties and functionality. "Verifying the properties and functionality" refers to testing and trying the goods as would be possible and customary in a retail store. Goods eligible for parcel post shall be returned to us at our risk. Return shipping costs shall be paid by you if the delivered goods correspond with those ordered and the price of the goods returned does not exceed a value of 40 Euro, or for items higher than said price, the return service or contracted partial payment has not been provided at the time of cancellation. Otherwise the return shipment is free of charge to you. Goods not eligible for parcel post shall be picked up from your location. Any obligations to refund payments shall be satisfied within 30 days. For you this term starts at the time your cancellation notice or product is sent, for us with receipt of such.

13. Bearing of costs agreement upon enforcement of the right to cancellation
You must pay the regular costs for the return shipment if the delivered goods correspond to those ordered and if the price of the goods to be sent back does not exceed 40,00 Euros, or in case of a higher price of the object you have not yet provided counterperformance or a contractually agreed partial payment at the time of cancellation.

15. Contract language
The language available for contract conclusion is english.
16. Right of cancellation for entrepreneurs
There is no right to cancellation for customers in the sense of §14 BGB (entrepreneurs).
17. Place of jurisdiction
Insofar the customer is entrepreneur, legal entity under public law or public special estate, Görlitz is agreed upon as exclusive place of jurisdiction.
18. Notice according to battery law
As our shipments may contain batteries and accumulators, we are obligated to inform you of the following, according to the battery law (BattG): Batteries and accumulators may not be disposed of in household waste. You are legally obligated to return used batteries and accumulators. Old batteries may contain pollutants that may damage the environment or your health upon improper storage or disposal. Batteries also contain important raw materials like e.g. iron, zinc, manganese or nickel and can be utilized You can either return the batteries to us after use, or return them in your vicinity (e.g. in a store or in communal collecting offices or in our shipping warehouse) free of charge. The return in stores is limited to the common quantity for end users, and to such old batteries that the store offered or still offers as new batteries in its product range.
The sign with the crossed out trashcan means that you may not dispose of batteries and accumulators in household waste. The following additional signs are usually applied under this sign, and have the following meanings:
